case study 1

We acted for a printing employer in relation to the sale of the business. This was a complex situation involving large sums of redundancy compensation as the result of numerous long-serving staff. We were involved in negotiations with the relevant union advising on employment issues in relation to the sale and transfer.

case study 2

We acted for the fledgling fast-ferry company Top Cat Fast Ferries when strike action was threatened as part of the wider waterfront industry show down. We assisted the company to avert a crippling strike action that would have closed the business and to successfully negotiate an agreement.

  • advising clients on issues surrounding the use of confidential information and restraints of trade.

case study 3

We acted for a property company in relation to the recovery of confidential information removed by a former employee to set up business in competition. This involved the issuing of proceedings for an injunction, which saw the return of the property and a restraint on its use in competition to the company.

general

  • advising on restrictive by-laws in relation to the running of a fast-ferry service. This involved advising on local government issues and resource management
  • advising on breach of contract in a sale and purchase of a residential home where the boundaries of the property had been misrepresented by the real estate agent
  • carrying out compliance audits and giving advice in all aspects of the Health and Safety in Employment Act 1992
  • negotiating contracts for senior and executive management (including several Chief Executives)
  • representing a Trustee in relation to a major dispute concerning a family Trust and farming business involving High Court proceedings
  • advising a client in relation to the millennium celebrations in 2000 involving negotiations with the Millennium Office
  • advising Boards of Trustees on matters relating to administration, compliance, and suspensions
  • assisting clients with personal grievance issues including attending mediations and adjudications
  • Barbara Buckett acts regularly as counsel and has appeared in many landmark cases in relation to redundancy and compensatory damages issues. Cases such as Castle v Rongotai College and Raddock v Air New Zealand.

We recently acted for a Government department and successfully defeated a personal grievance claim where the department had technically not followed its own procedure but where we argued the dismissal was substantively justified and inevitable.
